Temple-Inland warrants that, at time of shipment, TrimCraft engineered wood trim from Temple-Inland is free of defects in materials and workmanship.

Substrate

Temple-Inland further warrants that, for a period of 30 years from the date of original installation, TrimCraft will not, because of manufacturing defects, crack, chip, split, or delaminate in a manner that renders the trim materially unable to perform its function.

Factory-Applied Prime Coat

Temple-Inland warrants its factory-applied prime coat against peeling, cracking, or blistering from the substrate for a period of eight years after the date of installation. This limited warranty does not extend to coatings or finishes selected or applied by others to Temple-Inland primed engineered wood trim.

General Provisions and Limitations

The foregoing warranties apply only to TrimCraft installed on structures located within the continental United States and are expressly conditioned in compliance with the following terms:

• The trim must be properly stored, handled, installed and maintained in accordance with Temple-Inland's written instructions. Illustrated instructions on the care, maintenance and installation of engineered wood trim are provided in the installation instructions accompanying this product.
• The owner must conduct periodic inspections and perform routine maintenance of the engineered wood trim as specified in the installation instructions.
• Prior to undertaking any repair or replacement of affected trim, the owner must:
  (a) notify Temple-Inland, in writing, within 60 days of first discovering the condition complained of, at Temple-Inland, P.O. Drawer N, Diboll, Texas 75941, Attn: Product Manager-Fiber Products. Photos showing the nature and extent of the condition or defect should accompany the notice if possible, and
  (b) allow Temple-Inland a reasonable period of time (not to exceed 60 days from the receipt of the written claim) to inspect or investigate the trim's condition.

Exclusions

The foregoing warranties expressly exclude––and under no circumstances shall Temple-Inland have any liability for––any trim defect, damage or condition arising from or related to:

• Any stains, paints, coatings or other finishes applied by parties other than Temple-Inland;
• Acts of God, war, civil disorder, fire, lightning, hurricane, flood, tornado, earthquake, mud slide or other earth movement, air pollution, severe weather or similar phenomena;
• Movement, bowing, warping, cracking, settling, buckling or bulging of the structure or other material to which the engineered wood trim is attached (such as localized wall movement), or any other defects, failure or damage of material other than the trim;
• Vandalism, misuse, abuse, improper installation, improper or lack of maintenance, or other acts beyond Temple-Inland’s control;
• Extended or prolonged contact with moisture or water entering into or trapped behind the engineered wood trim, due to improper or incomplete flashing, caulking, sealing, or improper design, installation, or construction;
• Constant or repeated exposure to wetting by water sprinklers or other types of irrigation devices;
• Mold, mildew or fungus.

Remedies

1. Compensation—Substrate Limited Warranty.

With respect to any claim, damage or defect covered under the foregoing substrate limited warranty and subject to the maximum limits of compensation specified herein, Temple-Inland may elect, at its sole discretion, to either:

• Repair the affected trim, or replace the affected trim with trim of the same or similar type and specification (including installation costs), without charge to the owner, OR
• Compensate the owner with a cash payment equal to the reasonable cost of repair or replacement of the affected trim with similar trim, provided however that the "reasonable cost" of repair or replacement shall not exceed two times the original Temple-Inland sales price of the affected trim.

Furthermore, for any claims made after the eighth year of the warranty, the total dollar amount payable per surface square foot of affected trim shall be reduced by 1/22nd for each year following year eight of the 30-year warranty.

2. Compensation—Prime Coat Limited Warranty.

With respect to claims of damage or defect relating to the factory-applied prime coat, after the opportunity to inspect and investigate the claim, Temple-Inland may elect, at its sole discretion, to either (i) replace the affected trim with primed, comparable trim from Temple-Inland, uninstalled, or (ii) compensate the owner with a cash payment equal to the cost of refinishing the affected trim with one coat of single color, acrylic latex house paint. Any payment under this section shall be limited to no more than two times the amount of Temple-Inland's original sales price of the affected trim.

Arbitration of Disputes

If a claim under the foregoing warranties is not resolved to the owner’s satisfaction, disputes relating to the scope, coverage or application of the foregoing warranties, or to the nature or amount of any compensation due hereunder, shall be submitted to binding arbitration under the terms and conditions then in effect of the American Arbitration Association or any successor thereto. The foregoing Arbitration requirement shall not apply to issues involving multiple owners of different properties, or issues related to the availability or determination of legal requirements of class action status. The costs of such Arbitration proceeding shall be borne by the party incurring them.

This warranty states the entire liability of Temple-Inland with respect to the product named above, and nothing herein shall extend the duration of any implied warranties–including implied warranties of merchantability or fitness for a particular purpose–beyond the duration, if any, under applicable state law.

Under no circumstances will Temple-Inland be liable for incidental or consequential damages arising out of negligence, tort, breach of warranty, contract, strict liability, or any other basis. All such damages are specifically excluded.

Some states do not allow limitations on the exclusion of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

This warranty gives you specific legal rights. You may also have other rights, which vary from state to state.
